Terms and Conditions

These Terms and Conditions ("Terms") govern your use of PlanMyStops, including the website at planmystops.com and the PlanMyStops Driver app (together, the "Service"). The Service is operated by IT Summit Services ("we", "us"). By using the Service you agree to these Terms.

PlanMyStops is provided to businesses ("Customers") that use it to plan routes and dispatch their own staff. If a Customer has a separate signed agreement with us, that agreement controls wherever it conflicts with these Terms.

4. Safe driving

Do not operate the app while driving. Follow all traffic laws and your employer's safety rules. Routes, maps, directions, and arrival times are estimates and may be inaccurate; always use your own judgment on the road.

5. Location and data

The driver app collects location and photos while you are on an active route, as described in our Privacy Policy. Data entered into the Service belongs to the Customer. We use it only to provide the Service.

6. Third-party services

The Service uses third-party providers such as Google Maps Platform and QuickBooks Online. Their availability and accuracy are outside our control, and their own terms may apply.

7. Availability and changes

We work to keep the Service available but do not guarantee it will be uninterrupted or error free. We may update, change, or discontinue features.

8. Suspension and termination

We or the Customer may suspend or end your access if you break these Terms or if your employment or the Customer's subscription ends.

9. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

10. Limitation of liability

To the extent permitted by law, IT Summit Services is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount the Customer paid us for the Service in the 12 months before the claim.

11. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules.

12. Apple

If you use the iOS app, these Terms are between you and IT Summit Services, not Apple. Apple is not responsible for the app or its content, and Apple's Standard Licensed Application End User License Agreement also applies.

13. Changes to these Terms

We may update these Terms. We will change the effective date above, and continued use of the Service means you accept the updated Terms.
